Re: {PassionHR} Query on Gratuity.

Ofcourse he is not eligible for the same as he has not completed 5 years. but the law is 4 years and minimum of 240 days, he is eligible

1- He is not elligible for any gratuity bcoz gratuity applicable after 05 years continuous service.
2- Henceforth 2nd condition is also null.

Dear all,
 
One of our employee joined on 01st Jan 2004 and resigned from the service on 08th June 2007. Since the notice period is for 60 days, he worked for 8 days and amount for shortfall in notice period given for remaining 52 days.

 

My query is:-

  1. Since he worked for "4 Years, 159 days" whether he is eligible for Gratuity.
  2. Whether the 52days notice period amount given will be taken in to account for calculating gratuity period.
Please advise on this case.
