I read yr message, I would like to know the details of this case as I am working with a leading PSU and most of the officers are transferred with malafies intention of the management & HR.

Legal Tip of the Day

In case of malafides in transfer of service, courts would certainly interfere.

Transfer of railway officer, without any administrative exigency but only co-lateral and extraneous reasons is liable to be quashed since such a transfer was neither in public interest not due to administrative exigency. Normally the courts do not interfere with the orders of transfer of the employees since it is prerogative of the employer but in case there are malafides, then the courts would certainly vititate such transfer orders.
